This notice describes how medical information about you may be used and disclosed and how you can get access to this information. Please review it carefully.
This is a pre-operational draft. A finalized Notice of Privacy Practices, reviewed by healthcare counsel, will be provided to every client at admission and posted here before Everwell Recovery begins operating.
Heightened Protection for Substance-Use Records
Records of substance-use disorder treatment receive special federal protection under 42 CFR Part 2 in addition to HIPAA. In general, Everwell Recovery LLC may not say to a person outside the program that you attend the program, or disclose information identifying you as having a substance use disorder, unless you consent in writing, the disclosure is allowed by court order, or limited other exceptions apply (such as medical emergencies or reports of suspected child abuse or neglect).
How We May Use Your Information
- Treatment: coordinating your care within our team and, with your written consent, with outside providers.
- Payment: billing and coverage verification, with required consents.
- Operations: quality improvement and program administration, under strict confidentiality.
Your Rights
- Inspect and receive a copy of your records
- Request corrections to your records
- Receive an accounting of certain disclosures
- Request restrictions on certain uses and disclosures
- Request confidential communications (for example, contact only at a chosen number)
- Revoke a written consent at any time, except where action has already been taken on it
- Receive a paper copy of this notice on request
Complaints
If you believe your privacy rights have been violated, you may file a complaint with us at rojina@everwellrecoveryoc.com, with the U.S. Department of Health and Human Services Office for Civil Rights, and, for Part 2 violations, with the U.S. Attorney's office. You will never face retaliation for filing a complaint.
